Terms & Conditions

The terms you agree to when you book a stay at Antigua Villa.

1. Who you are booking with

Antigua Villa is a short-term rental on Marco Island, Florida, operated by Antivida LLC, a Florida limited liability company ("we", "us", "our"). Booking a stay creates an agreement between you and Antivida LLC. These terms, our house rules and the waiver together make up that agreement.

If you booked through a third-party booking platform, that platform's terms also apply. Where they differ from these terms on payment, cancellation or refunds, the platform's terms govern, because the platform holds the money.

2. Who may book

The guest making the booking must be at least 25 years old, must be one of the people staying, and must remain at the property for the whole reservation. That guest is responsible for everyone in their party, including for any damage caused.

3. Reservations and payment

  • Bookings are subject to availability and are not confirmed until payment has been taken and you have received a confirmation with a reservation code.
  • Payment in full is due at the time of booking, by card, through Stripe.
  • Prices are in US dollars. The total shown before you pay includes the nightly rate, the cleaning fee, our service fee and the occupancy taxes required by state and county law. The amount displayed is the amount charged.
  • Minimum and maximum stay lengths depend on the arrival date and are shown on the booking calendar.
  • No security deposit is taken at the time of booking. Responsibility for damage is covered in section 8.

4. Cancellations and refunds

If you booked through a third-party booking platform, the cancellation policy shown there when you booked governs your reservation, and the platform handles any refund. Nothing in this section changes that.

If you booked directly with us, the policy below applies to any stay of 27 or fewer consecutive nights. Longer stays are arranged individually and this section does not apply to them.

The 24-hour window. If you booked at least 7 days before check-in, you can cancel within 24 hours of confirmation for a full refund, including taxes. A booking made less than 7 days before check-in does not have this window.

After that:

  • 30 days or more before check-in — full refund, including taxes and our service fee.
  • Between 7 and 30 days before check-in — 50% refund of the accommodation total, plus the tax charged on the refunded half. The cleaning fee is refunded in full.
  • Less than 7 days before check-in — no refund of the accommodation total. The cleaning fee is still refunded in full, along with the tax charged on it.

The cleaning fee comes back on any cancellation before check-in, because no clean has happened. Our service fee is refunded only where you receive a full refund — the card processing cost on the original payment is not returned to us, so it cannot be given back twice.

Pool heating, if you bought it, is refunded in full whenever you cancel before check-in.

After check-in there is no refund for leaving early or for a night you do not use.

Cancellations must be in writing, through the guest portal or by email. The date and time we receive it is what counts, in Eastern time, the property's local time.

We strongly recommend travel insurance. Southwest Florida's hurricane season runs June through November, and insurance is the only thing that covers a trip you decide not to take.

5. If we have to cancel

If we have to cancel — serious damage, a failure that makes the house unusable, or a mandatory evacuation order — we refund everything you have paid for the nights you cannot use. That refund is the limit of what we owe. We are not responsible for flights, car hire, or other costs you have committed to elsewhere.

6. Check-in and check-out

Check-in is from 4:00 PM and check-out is by 10:00 AM. Earlier check-in or later check-out may be possible on request and subject to availability. Access details are sent through the guest portal before you arrive.

7. Occupancy and guest list

Maximum occupancy is 8 people. A guest list with the full names and ages of everyone staying overnight, or visiting, must be provided at least 24 hours before arrival, and anyone not on that list needs approval in advance. Guests not on the reservation are charged $150 per person, per night.

8. House rules, waiver and damage

Every stay requires the waiver to be signed in the guest portal before check-in. It is a condition of the stay, and check-in cannot be completed without it.

The house rules form part of these terms. In particular:

  • Smoking and vaping are prohibited anywhere on the property, and no pets are permitted. Either can result in charges of up to $1,500.
  • The boat lift may not be used or climbed on by anyone in your party.
  • You are responsible for the cost of repairing any damage your party causes to the dock or seawall.
  • Parking is limited to two cars outside the garage. City ordinance fines for parking on swales or sidewalks run to as much as $1,700 per day.
  • You are responsible for damage beyond ordinary wear and tear.

9. Pool heating and other extras

Pool heating is optional, billed per night, and bought separately through the guest portal. A heat pump draws warmth from the air, so it cannot hold temperature during a cold snap. Heating charges are not refunded on account of the weather.

10. Security cameras

The property has security cameras covering the yards, the garage and the rear boat dock, as described in the waiver and in our Privacy Policy. Disabling, covering or obstructing them is a breach of these terms.

11. Liability

To the fullest extent permitted by Florida law, our liability arising out of your stay is limited to the amount you paid for the booking. We are not liable for lost, stolen or damaged personal property, or for anything that happens on the water. Nothing in these terms limits any liability that cannot lawfully be limited.

12. This website

The photographs, descriptions and other content on this site belong to Antivida LLC. You are welcome to link to it, and search engines and AI assistants are welcome to crawl, index and quote it — that is what it is here for. What you may not do is republish our photographs or listing copy as your own, or hold this property out as available through you.

We work to keep availability, rates and descriptions accurate, but details change. A price is binding once you have booked at it; a price shown and not yet booked is not an offer we are unable to correct.

13. Governing law

These terms are governed by the law of the State of Florida. Any dispute arising from them or from your stay goes to the state or federal courts serving Collier County, Florida.

14. If part of this does not hold

If any provision of these terms is found unenforceable, it is severed and the rest remains in full effect.

15. Changes to these terms

We may update these terms, and the current version is the one shown on this page. We do not apply changes retroactively: the cancellation policy you booked under is the one we will honour, whatever this page says later.
